ORDER OF TRIAL/PRESENTATION OF EVIDENCE

1. States case in chief – The State rests.
a. Defense Motion for Directed Verdict (if raised).
See MOTION FOR JUDGMENT OF ACQUITTAL ALLOWING THE STATE TO REOPEN AFTER A MOTION FOR JUDGMENT OF ACQUITTAL IS MADE and MOTION FOR JUDGMENT OF ACQUITTAL - TEN BASIC FACTS
2. Defense case in chief (if any).
a. After the state rests and before the defense puts on a defense the court should excuse the jury and determine, thru questions from the court or the defense attorney, if the defendant is going to testify or not testify. See WAIVER OF 5TH AMENDMENT RIGHT-DEFENDANT TESTIFYING/NOT TESTIFYING IN CRIMINAL CASE for the procedure to follow.
b. Make record of defendant’s decision
3. States Rebuttal Case (if any) – The State re-rests.
4. Defense Sur-Rebuttal Cases (if any) – The Defense re-rests.
a. Defense Motion for Directed Verdict (if raised).
5. States Closing Argument
6. Defense Closing Argument
7. States Rebuttal Closing Argument (M.R.C.P. 26.03, subd 11 (j))
8. Defense Rebuttal Closing Argument (if requested and proper showing made)
9. Motions concerning closing arguments, jury instructions, etc.
10. Final Jury Instructions
a. Make record of defendant’s approval concerning Final Jury Instructions
b. Make record of defendant’s decision on Crim Jig 3.17 (defendants right not to testify; give only if def asks and makes a clear record)
11. Review of Admitted Physical Evidence

The attorneys and the judge or the clerk should physically examine all of the admitted physical evidence and determine , using evidence lists

a. That all admitted evidence is in the group of physical evidence that will be given to the jury, and
b. That there is nothing in the group of physical evidence that has not been admitted.
c. Containers and documentary evidence should be examined to determine that there is nothing in the container that has not been admitted and that the foundation for both sides of an admitted document have been established.
